BREAKING, READ: Arpaio Moves To Not Only Vacate Sentencing, But Un-do Guilty Verdict

(UPDATE, 4:30p.m.: Judge Susan Bolton's office has acknowledged receiving the Presidential pardon and has placed it on the U.S. v. Arpaio docket, without comment.)

Attorneys for former Maricopa County Sheriff Joe Arpaio filed a motion this morning to not only vacate the October 5 sentencing of their client for the misdemeanor criminal contempt of court order, but also to vacate the Court's finding of guilt altogether.

U.S. District Court Judge Susan Bolton found Arpaio in criminal contempt last month. Late this past Friday, President Donald Trump pardoned Arpaio "for his conviction" and for any other actions against him that could arise in the future from the Melendres v. Arpaio ongoing civil rights matter.

Arpaio's attorneys likely expect that there will be opposition to today's motion and have requested oral argument. It may be difficult for the U.S. Department of Justice to oppose the motion, given the Presidential pardon, but it is also possible that attorneys involved in the Melendres case may attempt to intervene and oppose.
